WSIB Return to Work – The Duty to Cooperate

The Workplace Safety and Insurance Board requires employers to have a return to work program in the event that a worker is injured or ill due to a work related incident. A return to work program helps to facilitate the return of an injured/ill worker to work by providing accommodation where necessary. Having an effective Return to Work program ensures the dignity and productivity of a worker. All workplace parties have a duty to cooperate in the return to work process. These obligations to cooperate include:

      • initiating early contact
      • maintaining appropriate communication throughout the worker’s recovery
      • identifying and securing work reintegration opportunities for the worker
      • giving the WSIB all relevant information concerning the worker’s work reintegration, and
      • notifying the WSIB of any dispute or disagreement concerning the worker’s work reintegration.
