When do you need to report an incident to the WSIB?
Employers are required to report an incident to the WSIB within 3 days if the worker:
• Loses time from work, or
• Earns less than a regular day’s pay, or
• Gets health care treatment (doctor, emergency room, walk-in clinic etc.), or
• Requires modified duties with full pay for more than 7 days
Employers are not required to report the incident to the WSIB if the worker only needs first aid, and returns to work. The worker can receive up to 7 days of modified duties at full pay without the employer having to report to WSIB, as long as the worker does not need more than first aid.
If the workers does seek medical attention, or the injury/illness requires modified duties longer than 7 days, the employer is required to report the incident to the WSIB.
Failing to report an injury on time to the WSIB will result in a penalty of $250.
Employers are required to keep a record of ALL incidents, as well as record what happens during the workers recovery.
