In Canada, each province and territory is responsible for the administration and enforcement of occupational health and safety regulations. With limited exceptions, every workplace is required to act in accordance with these laws.
In Ontario, the Occupational Health and Safety Act (OHSA) sets the standard for safety in the workplace. Different regulations are written for various industries, for example Construction Projects (O. Reg 213/91), Industrial Establishments (O. Reg 851), and Health Care and Residential Facilities (O. Reg 67/93). The aim is to protect against workplace accidents, injuries and illnesses. The OHSA also outlines the consequences of not complying with the Act and its Regulations, which may include financial penalties and imprisonment.
The Ontario Occupational Health and Safety Act states that the employer is required to take every precaution reasonable in the circumstance for the projection of a worker. This includes, but is not limited to, providing training, keeping employees informed of hazards and developing safe work procedures. In Ontario, employees have a legal right to refuse unsafe work.
